AN ACT CREATING THE DEVENS ENTERPRISE COMMISSION

SECTION 15. Application for Devens Property

  1. The Towns, or any one or more of them in concert, following notification of and coordination with the Bank, or the Bank itself may submit a request to the Department of the Army, or any other appropriate agency of the federal government, for the transfer of a portion of Devens for a direct public use by the submitting entity, in conformance with the Reuse Plan, for which use said portion is eligible to be transferred as a public benefit transfer under the acts described in this section, hereinafter referred to as the "Eligible Acts."

  2. Any public agency, profit or not for profit organization or corporation or instrumentality of the Commonwealth with the written approval of the Bank may submit a request to the Department of the Army, or any other appropriate agency of the federal government, for the transfer of a portion of Devens for a direct public use by the submitting entity, in conformance with the Reuse Plan, for which use said portion is eligible to be transferred under the "Eligible Acts" described in this section.

  3. The Eligible Acts are as follows: 40 U.S.C.A. section 484(k) and (p), 50 U.S.C.A subsection 1622(g), as amended; 16 U.S.C.A. subsection 667 b-d, as amended; 23 U.S.C.A. subsection 107 and subsection 317, as amended; and 40 U.S.C.A. subsection 345(c), as amended.
